The cutest trademark dispute you’ve ever seen

Sometimes you come across trademark disputes that make you forget for a moment the serious consequences of trademark infringement. One such example was a dispute between two unicorns that are, as the Japanese would say, "kawaii" (cute and lovable).

At a first glance, it is pretty clear that there's no similarity between them.

However, the European Trademarks Office still had to look at each element in detail and provides a comprehensive description of the trademarks in question, including their features and the way they are put together. After analysing the trademarks, the assessment follows. they differ in shape and expression and it is therefore clear that there is little visual similarity between them. Conceptually, however, there is a similarity between these trademarks as they both feature unicorns.

The final question was whether the trademarks were similar enough for there to be a risk of confusion. The European Trademark Office concluded that there was no risk of confusion because the trademarks were fundamentally different. As a result, these cheerful little characters are both allowed and can co-exist without any problems.
